Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Dinny mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. If you are using the App on behalf of a minor (a child under the age of legal capacity in your jurisdiction), you represent that you are the child's parent or legal guardian and accept these Terms on their behalf.

2. Description of Service

Dinny is a family dinner planning application that allows household members to plan meals, view dinner schedules, and receive reminders. The App provides features including meal planning, a weekly schedule view, a meal library, smart notifications, household management, and real-time synchronisation across family members' devices.

3. Accounts and Registration

3.1 Account Creation

You may create an account using Google Sign-In or Apple Sign-In. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

3.2 Guest Access

Family members may join a household as guest users using a display name and an invite code, without creating a full account. Guest access is intended for family members, including children, who do not need full account management capabilities.

3.3 Household Management

Household administrators are responsible for managing their household, including inviting members, assigning roles, and regenerating invite codes. Administrators should only share invite codes with intended family members.

4. Acceptable Use

You agree not to:

Use the App for any unlawful or prohibited purpose
Attempt to gain unauthorised access to other users' households or data
Interfere with or disrupt the App's services, servers, or networks
Reverse-engineer, decompile, or disassemble the App
Use the App to transmit harmful, offensive, or inappropriate content
Share invite codes publicly or with individuals outside your intended household
Create multiple accounts to circumvent restrictions or abuse the service

5. User Content

You retain ownership of any content you submit through the App, including meal names, notes, and household information ("User Content"). By submitting User Content, you grant us a limited licence to store, process, and display that content as necessary to provide the App's services to you and your household members. We do not claim ownership of your User Content.

6. Notifications and Communications

The App may send push notifications related to dinner plans, reminders, and schedule changes. You can manage your notification preferences within the App's settings. By enabling notifications, you consent to receiving these communications on your device.

7. Intellectual Property

The App, including its design, features, code, graphics, and branding (excluding User Content), is owned by Dinny and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Availability and Modifications

We strive to keep the App available at all times but do not guarantee uninterrupted service. We reserve the right to modify, update, or discontinue the App or any of its features at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the App.

9. Account Termination

You may terminate your use of the App at any time by:

Signing out of the App
Leaving your household (for guest users)
Deleting your account through Settings > Account > Delete Account, which permanently removes all your data

We reserve the right to suspend or terminate your account if you violate these Terms or engage in behaviour that is harmful to other users or the service.

10. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, secure, or available at any particular time or location.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Dinny and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the App, whether based on warranty, contract, tort, or any other legal theory, regardless of whether we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold harmless Dinny and its developers from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

13. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

14. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be available within the App and on our website. If we make material changes, we will notify you through the App. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
